Source of Funds: Why Preparation Should Start Early

The capital is only part of the equation. The lawful source and path of funds need a clear, supportable record.

One of the most avoidable EB-5 problems is waiting too long to organize the lawful source and path of the investment capital.

Think in terms of a documented story

It is not enough to know where the money came from. The petition needs evidence that allows immigration counsel to present the lawful source and trace the path of funds into the investment.

Different families have different evidence

Capital may come from employment earnings, business income, asset sales, gifts, inheritance, loans or a combination of lawful sources. The documentation required can differ significantly depending on the facts and jurisdiction.

Complex does not necessarily mean impossible

Older records, multiple bank accounts, cross-border transfers and family gifts can make documentation more involved. That is a reason to begin earlier and involve experienced immigration counsel, not a reason to improvise an explanation at the end.

Do not move money simply to make the file look cleaner

Before restructuring, gifting, borrowing or transferring funds for EB-5 purposes, discuss the proposed path with qualified counsel and any appropriate tax or financial advisors. A transaction can have consequences beyond immigration.

Preparation creates options

Families who begin source-of-funds work early have more time to identify missing records, clarify transactions and coordinate the investment timeline with counsel.
